This Privacy Notice describes how PerBlue Entertainment, Inc. (collectively, “PerBlue,” “we,” or “us”) collects, uses, discloses and otherwise processes information about you. This Privacy Notice applies to information we collect when you access or use our websites (collectively, the “Website”), our games and associated services or platforms (collectively the “Games”), or when you otherwise interact with us, such as through social media. This Privacy Notice is effective as of the “Last Updated” date above. We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the “Last Updated” date. Where required by law, we will notify you of and seek your consent to the changes. We encourage you to review this Privacy Notice regularly to stay informed about our information practices and the choices available to you.
COLLECTION OF INFORMATION
Information You Provide to Us
We collect information directly from you when you visit the Website, use a Game, request customer support, or otherwise interact with us, such as through our Game forums. The categories of information we collect include:
- Identification Information: We generate an ID number that we associate with your account (your “PerBlue ID”). In certain circumstances we may also collect additional identification like your name or alias, email address, age, government identification documents, mailing address, country of residence, profile picture, Facebook ID, Game Center ID, or Google Play Games ID.
- Financial Information: we engage third party payment processors to collect your payment information.
- Communication Information: we collect information included in your communications with us. If you contact our in-Game support team, we may associate your PerBlue ID with additional information you submit in connection with your support request like your name and/or email.
We may also collect any other information you choose to provide.
Information We Collect Automatically
We automatically collect the following categories of information:
- Transactional Information: we keep a history of your transactions with us, including the dates and amounts paid for the Games and in-Game purchases.
- Internet Activity Information: we collect information about how you access our Website and Games, including data about the device and network you use, such as your hardware model, operating system version, mobile network, default language, country, time zone, IP address, MAC address, unique device and advertising identifiers, and browser type. We collect information about actions you take in our Games, such as characters collected, battle results, guild creation/participation, and virtual currency acquisition/use (your “Gameplay Information”) and your activity on our Website/interaction with our communications (such as access times, pages viewed, links clicked, and the page you visited before navigating to our Website).
Information Collected by Cookies and Similar Technologies: We use technologies, such as cookies and pixels, to collect information about your interactions with our Website and communications and provide analytical information. These technologies help us improve our Website and communications, see which areas and features of our Website are popular, count visits, and track clicks. You may be able to adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Website. We also use SDKs, or software development kits, to collect Gameplay Information for digital advertising and analytics purposes.
Information We Collect from Other Sources
We obtain information from other sources. For example, we may be able to access to certain information associated with your Facebook ID, Game Center ID, or Google Play Games ID, such as your name and profile picture , in accordance with the authorization procedures determined by such platform. We may also collect information you share when you interact with us on social media platforms like Facebook.
Derived Information
We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address.
USE OF INFORMATION
We use the categories of information we collect for the following business and commercial purposes:
- Service Delivery: we use information to provide and maintain our Games, including to personalize your Game experience, process payments, and authenticate your account.
- Analytics and Performance Monitoring: We analyze user behavior and engagement to understand how our Games are used, identify performance issues, and make improvements. This includes aggregating data to evaluate gameplay trends, usage patterns, and technical diagnostics.
- Install Attribution: We work with third-party Mobile Measurement Partners (MMPs) to understand how users discover and install our Game. These partners help us attribute installs and other user events to specific marketing campaigns or ad sources by collecting device identifiers (such as IDFA or GAID), IP addresses, and other data. This allows us to evaluate the effectiveness of our advertising and optimize our user acquisition strategies.
- Communication: we use information to communicate with you via email or push notifications about PerBlue and our Games, including to respond to your questions, provide support, inform you of price or Games changes, and send you other transactional or relationship messages. We may also send you other promotional email messages if you opt-in. You may opt-out at any time by clicking “Unsubscribe” in the footer of emails, and you can adjust or disable push notifications in your device’s Settings.
- Advertising: we engage others to serve digital advertisements and perform related services in some of our Games. These entities may use cookies, web beacons, SDKs, and other technologies to collect information about your use of our Games, including your IP address, and device identifiers. This information is used to deliver advertising tailored to your inferred interests and are intended to be more relevant and engaging.
- Contests: we may use personal information to administer contests, sweepstakes, and promotions and deliver rewards and prizes.
- Research and Development: we use information to monitor and analyze Website trends, usage, and activities, improve our Website and Games, develop new games, and generate de-identified data that we will not re-identify.
- Protection and Compliance: we use information to detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity, help protect the rights and property of PerBlue and others, and comply with our legal and financial obligations.
- Notice/Consent: we may also use information in other circumstances after giving you notice and/or getting your consent.
DISCLOSURE OF INFORMATION
We disclose the categories of information described above as follows:
- Vendors: we disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with web hosting, payment processing, fraud prevention, customer service, data enrichment, analytics, and marketing and advertising.
- Advertising and Install Attribution Partners: we disclose information to third parties for the Advertising purposes described above.
- Professional Advisors: we disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
- Legal Authorities: we may disclose information to legal authorities and others for the Protection and Compliance purposes described above, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of PerBlue, our users, the public, or others.
- Corporate Transactions: we reserve the right to disclose information in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- Affiliates: we reserve the right to disclose information between and among PerBlue and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.
- Consent: we may disclose information when we have your consent or you direct us to do so.
We also disclose de-identified information that cannot reasonably be used to identify you.
Please note that any information you post, upload, or disclose on forums, guilds, and other social features may be available to other users and the general public.
CHILDREN’S PRIVACY
Our Games are not intended for or directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. Some of our Products may have stricter age limits, in our discretion, even where we are not required by applicable law to limit to such an age. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE GAMES AT ANY TIME OR IN ANY MANNER. Children under 13 (or the age of digital consent in the applicable jurisdiction or the age we require for a specific Game), are prohibited from and should not use or attempt to use our Games or send us any information about themselves.
If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information as soon as possible. If you are a parent or legal guardian and believe that your child under 13 has provided us with personal information, you may contact us at legal@perblue.com to request that the information be removed.
LINKS TO OTHER SITES
Our Games and Website may contain links to third-party websites, services, or content that are not operated or controlled by PerBlue. We are not responsible for the privacy practices or the content of those third parties. If you choose to visit or interact with any third-party site or service, we encourage you to review their privacy policies and terms of use. Your interactions with those sites are governed by their own policies and not by this Privacy Notice.
SECURITY OF INFORMATION
We take reasonable administrative, physical and electronic measures to protect your personal information. Unfortunately, however, no security system can be 100% secure. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time. Accordingly, we cannot guarantee the absolute security of any information.
TRANSFER OF INFORMATION
PerBlue is headquartered in the United States and we have operations and vendors in the United States and other countries. Therefore, we and our vendors may transfer your personal information to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection to your home jurisdiction.
JOB APPLICANT INFORMATION
When you apply for a position with PerBlue, we collect the information that you provide in connection with your application. This includes name, contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or provided during interviews (which may be recorded). This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information.
We use applicants’ information to facilitate our recruitment activities and process applications, including evaluating candidates and monitoring recruitment and hiring statistics. We use successful candidates’ information to administer the employment or independent contractor relationship. We may also use and disclose applicants’ information (a) to improve our Website, (b) as otherwise necessary to comply with relevant laws, (c) to respond to subpoenas or warrants served on Company, and (d) to protect and defend the rights or property of PerBlue or others.
RESIDENTS OF CERTAIN US STATES AND CANADA
Privacy laws in Canada and certain US states like California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia require additional disclosures and grant their residents certain rights. This section applies to residents of those areas.

Your Privacy Rights
Access, Correction, and Deletion
You have the right to (1) request to know more about and access your personal information, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information.

We may verify your request by asking you to verify your email address and/or provide information related to your recent interactions with us. If we deny your request, you may appeal by contacting us.
Opting Out of Sales, Sharing, and Targeted Advertising
As described in the Advertising and Analytics section above, we process personal information to understand and improve your experience with our Games and to possibly serve you advertisements in the Games. These activities may result in us sharing Identification Information, Internet Activity Information, and Derived Information with our Advertising Partners (including social media platforms) so our Advertising Partners can show ads that are targeted to your interests. These activities may be considered targeted advertising under certain laws. You have the right to opt out of sharing, sales, and targeted advertising at any time by discontinuing your use of our Games and deleting your account. You may also enable a browser-based opt-out signal such as Global Privacy Control (GPC), which we honor where technically feasible. We do not “share” or “sell” any other categories of personal information nor do we knowingly “sell” or “share” personal information about consumers under the age of 16.
Nondiscrimination
We will not treat you differently for exercising your privacy rights.
Authorized Agents
If you are submitting a rights request as an authorized agent, you must submit proof of your authorization to make the request, such as a valid power of attorney or signed permission from the subject of the request. Please do not provide any sensitive personal information in connection with this request, such as a driver’s license or other government-issued ID. In some cases, we may contact the subject of the request for verification. If you are an authorized agent seeking to make a request, please contact us.
Data Retention
We store personal information for as long as necessary to carry out the purposes for which we originally collected it, satisfy our legal requirements, or for other business purposes explained in this Privacy Notice.
RESIDENTS OF THE EEA
Residents of the European Economic Area (“EEA”) and some other jurisdictions including Switzerland and the United Kingdom (“UK”) outside the United States have certain legal rights with respect to the personal data we hold about them.
Such residents may request that we:
- provide access to personal data we hold about them (including, in some cases, in portable form)
- rectify such data
- delete certain personal data
- object to our uses or disclosures of personal data or exercise legal rights to withdraw consent
Such requests will be processed in line with local laws, including without undue delay and in accordance with any required time frames. Although PerBlue makes good faith efforts to provide individuals with access to their personal information, there may be circumstances in which PerBlue is unable to provide access, including, but not limited to,: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question or where it is commercially proprietary. If PerBlue determines that access should be restricted in any particular instance, we will endeavor to provide you with an explanation of why that determination has been made within any required time frames (approximately one month), a contact point for any further inquiries and any other legally required information. To protect your privacy, PerBlue will take commercially reasonable steps to verify your identity before granting access to or making any changes to your personal information.

We process the Personal Data of European Data Subjects on the following lawful bases:
- Legitimate Interests. Where the processing is necessary for the purposes of the legitimate interests pursued by PerBlue or by a third party and not overridden by your fundamental rights and freedoms (e.g., product development and security purposes);
- Performance of a Contract. Where the processing is necessary for the performance of a contract with you (e.g., to deliver the service you have requested);
- Consent. Where you have given explicit consent to the processing of your Personal Information for one or more specific purposes (e.g., new and unexpected processing activities); and
- Legal Obligation: Where processing is necessary for compliance with a legal obligation to which Playbite is subject (e.g., compliance with laws and regulations).
In this case, we rely on the following lawful basis for processing Personal Data for the purposes set forth below:
